1. General Provisions

These Terms of Service specify the conditions for providing translation and legalization services by Fiery Income with its registered office at 3, Jalan Ceylon, Bukit Ceylon, 50200 Kuala Lumpur, Wilayah Persekutuan Kuala Lumpur, Malaysia.

The Terms apply to all Clients using services offered by Fiery Income, regardless of the method of placing an order (in person, by phone, through the website or email).

By using Fiery Income services, the Client accepts these Terms of Service in their entirety.

2. Definitions

Terms used in these Terms of Service mean:

  • Fiery Income/Contractor - company providing translation and legalization services
  • Client/Ordering Party - natural person, legal entity or organizational unit without legal personality that uses the Contractor's services
  • Service - any service offered by the Contractor, including sworn translations, apostille, consular legalization
  • Source document - document submitted by the Client for translation or legalization
  • Translation - document translation performed by a sworn translator
  • Apostille - certification according to the Hague Convention of 1961
  • Order - service order placed by the Client

3. Scope of Services

Fiery Income offers the following services:

3.1. Sworn Translations

  • Personal document translations (civil status certificates, identity documents, etc.)
  • Legal document translations (contracts, powers of attorney, court judgments)
  • Medical document translations (test results, treatment information cards)
  • Educational document translations (diplomas, certificates, transcripts)
  • Business document translations (financial reports, company statutes)

3.2. Legalization Services

  • Apostille of documents according to the Hague Convention
  • Consular legalization for countries outside the Hague Convention
  • Certificates of conformity with the original
  • Signature legalization

3.3. Additional Services

  • Express 24h - expedited order processing
  • Document pickup and delivery
  • Consultations regarding required documents
  • Assistance in completing documentation

4. Contract Formation

The service agreement is concluded when:

  • The order is accepted by the Contractor and confirmed in writing (email) or by phone
  • The Client pays a deposit (if required)
  • Source documents are submitted to the Contractor

Each order requires:

  • Specification of service scope
  • Indication of completion time
  • Price agreement
  • Provision of Client's contact details

Important!

The Contractor reserves the right to refuse an order without giving a reason, especially in case of documents of questionable authenticity or origin.

5. Parties' Obligations

5.1. Client's Obligations

  • Submission of legible and complete source documents
  • Provision of true and complete contact details
  • Timely payment for services rendered
  • Provision of all necessary information regarding the order
  • Collection of completed documents at the agreed time
  • Return of source documents (if applicable)

5.2. Contractor's Obligations

  • Performance of services according to the order and applicable regulations
  • Confidentiality of received documents and information
  • Timely order completion
  • Informing the Client about order progress
  • Return of source documents after service completion
  • Document copy storage according to legal requirements

6. Prices and Payments

6.1. Pricing Principles

Service prices are determined individually for each order based on:

  • Type of document
  • Translation language
  • Text difficulty level
  • Completion time
  • Additional services

6.2. Payment Methods

The Client can make payment:

  • In cash upon collection
  • By bank transfer
  • By credit card
  • Electronic payments (BLIK, PayU)

6.3. Payment Terms

  • Deposit payment - required before work begins (for orders above MYR 500)
  • Cash payment - upon document collection
  • Bank transfer payment - within 7 days from invoice date
  • Business payment - according to agreement terms

7. Delivery Times

7.1. Standard Times

  • Sworn translations - 3-5 business days
  • Apostille - 5-7 business days
  • Consular legalization - 10-14 business days
  • Specialized translations - 5-10 business days

7.2. Express Mode

Express processing (24-48h) is available for an additional fee of 50-100% of the basic service price.

7.3. Delays

Delivery times may be extended due to circumstances beyond the Contractor's control:

  • Waiting time for apostille in offices
  • Queues at consulates
  • Holidays and non-working days
  • Unforeseen circumstances (pandemic, strikes)

8. Complaints

8.1. Complaint Grounds

The Client has the right to file a complaint in case of:

  • Substantive errors in translation
  • Non-compliance of the service with the order
  • Document damage
  • Exceeding the agreed completion time

8.2. Complaint Procedure

  • Complaints should be submitted in writing within 14 days of service receipt
  • Complaints should contain problem description and Client's request
  • The Contractor considers complaints within 14 business days
  • Complaint response is provided to the Client in writing

8.3. Complaint Resolution Methods

If the complaint is accepted, the Contractor may:

  • Correct translation errors free of charge
  • Perform the service again
  • Refund all or part of the paid amount
  • Propose another solution satisfactory to the Client

9. Liability

9.1. Contractor's Liability

The Contractor is liable for:

  • Substantive quality of translations
  • Timeliness of service delivery
  • Safety of entrusted documents
  • Confidentiality of information contained in documents

9.2. Liability Exclusions

The Contractor is not liable for:

  • Damages resulting from false source documents
  • Refusal to accept translations by third-party institutions
  • Delays caused by offices and consulates
  • Consequences of actions taken based on translations
  • Indirect damages and lost profits

9.3. Insurance

The Contractor has professional liability insurance for the amount of MYR 100,000.

10. Data Protection

Processing of Clients' personal data is conducted in accordance with:

  • GDPR Regulation
  • Personal Data Protection Act
  • Privacy Policy available on the website

11. Final Provisions

11.1. Terms of Service Changes

The Contractor reserves the right to make changes to these Terms. Changes come into effect after notifying Clients and publishing on the website.

11.2. Governing Law

All matters not regulated in these Terms shall be governed by Malaysian law, in particular:

  • Civil Code
  • Sworn Translator Profession Act
  • Apostille and legalization regulations

11.3. Dispute Resolution

Any disputes between the parties shall be resolved by the court having jurisdiction over the Contractor's registered office.
